1. Agreement

By accessing or using image.faytronix.com ("the Service") you agree to these terms. If you do not agree with them, please do not use the Service.

2. The Service

The Service is a browser-based image editing tool. All processing takes place on your own device. We provide the software that runs in your browser; we do not provide storage, hosting or processing of your files.

The Service is provided free of charge. We may modify, suspend or discontinue any part of it at any time without notice.

3. Your images and your rights

You retain all ownership and intellectual property rights in the images you open, edit and export. We claim no licence or interest in them whatsoever. Because your files are never transmitted to us, we could not do so even if we wished to.

You are solely responsible for having the legal right to edit the images you use with the Service.

4. Acceptable use

You may use the Service for personal and commercial purposes. You may not use it to:

• process images that are unlawful in your jurisdiction, including child sexual abuse material, which we report to the relevant authorities wherever we become aware of it;
• create material intended to deceive, defraud or impersonate another person;
• infringe the copyright, trade marks or other rights of any third party;
• interfere with, disrupt or place unreasonable load on the Service or its hosting;
• attempt to circumvent any technical restriction or security measure.

5. Intellectual property in the Service

The Service, including its source code, interface design, text and graphics, is owned by FAYTRONIX and protected by copyright. Viewing the code in your browser's developer tools does not grant you a licence to copy, redistribute, host or resell it. You may not create derivative works from it, or operate a copy of it on another domain, without our prior written permission.

6. No warranty

The Service is provided "as is" and "as available", without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that any particular output will meet your requirements. Image processing depends on your browser and device, and results may vary between them.

Keep your originals. Editing is non-destructive and your source files are not modified, but you should always retain a copy of any image that matters to you.

7. Limitation of liability

To the fullest extent permitted by law, FAYTRONIX shall not be liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of data, profits, revenue or goodwill, arising from or connected with your use of the Service.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud.

8. Advertising

The Service is supported by advertising. Advertisements are served by third parties and their presence does not constitute an endorsement by us of the advertiser, their products or their claims. Any dealings you have with an advertiser are solely between you and them.

9. Privacy

Our handling of data is described in the Privacy Policy, which forms part of these terms.

10. Changes

We may revise these terms from time to time. The date at the top of this page shows the current version. Continuing to use the Service after a change constitutes acceptance of the revised terms.
